Borough Ordinance Violations

Although the Borough Code is quite extensive, the following are some of the more common ordinances which are dealt with on a regular basis:

Underage Drinking 71-1.1 Any person under the legal age to purchase alcoholic beverages who knowingly possess or consumes any alcoholic beverage in or on school property, public conveyance, public place, or on private property shall be in violation. Upon conviction of a first offense, a $250 fine ($350 for subsequent offense), 180 days community service, drivers license suspended or postponed for 6 months.

Parking

No person shall park any vehicle on any street or road within the borough between the hours of 11:00pm and 6:00am

It shall be unlawful for any person to park any motor vehicle, including automobiles, trucks, motorcycles or mopeds on any public property of the Borough of Saddle River unless the operator of that vehicle has some business upon or is attending a public function located on said property. In no event shall it be lawful to park ant motor vehicle as defined above on any public property between the hours of 11:00pm and 7:00am without the express consent and prior approval of the Saddle River Police Department.
Noise 146-2

 

The making, creation or permitting of any unreasonably loud, disturbing or unnecessary noise in the Borough of Saddle River is hereby prohibited, especially between the hours of 11:00pm and 7:30am. Consequently, no person shall, between the hours of 11:00pm and 7:30am, permit any noise to emanate from any source or instrument, whether natural or artificial, or use equipment outside a fully enclosed principal dwelling on a residential property such that the noise created thereby is plainly audible at the boundary line of such property.
Noise 146-2(5) Prohibits creating any audible noise by landscaping or the erection, excavation, demolition, alteration or repair of any building between the hours of 7:30am and 6:00pm (Monday through Friday), and 9:00am and 4:00pm on Saturday, except in the case of urgent matters in the interest of public safety and health.
Animals 79-2

No person shall keep any animal which causes frequent or long-continued loud and raucous noises so as to disturb the comfort or repose of any person in the vicinity.
Animals 79-10 Any person who shall own, keep or harbor a dog of licensing age shall, in the month of June and annually thereafter, apply for a license and registration tag for each such dog.
Animals 79-3

Any person owning or having in his custody animals, and whose animals shall run at large beyond the boundary line of the property of such person to the injury or annoyance of others, shall be guilty of a violation and subject to a penalty. Such action is declared to be a nuisance and dangerous to public health and safety.
Open Burning 113-9 No person or commercial establishment shall cause, suffer or allow or permit the disposal of rubbish, garbage, trade waste (such as building materials), fallen leaves or any other type of plant life by open burning without having first obtained a permit for said open burning from the Fire Prevention Sub code Official.
Dumping 187-11 It shall be unlawful for any person, firm, or corporation, whether as principal, agent, servant, employee or otherwise, to dump in mass any refuse, ashes, garbage, papers, factory waste or organic or inorganic matters on any land, road, street, alley or lane in the Borough of Saddle River.
Littering 142-9 No person shall throw, deposit or store litter on any occupied private property, whether owned by such person or not.
142-4 No person shall throw or deposit litter upon a public or private place from a vehicle.
142-4(B) No person shall drive or move a truck or other vehicle unless the vehicle is so constructed, loaded or covered as to prevent any load or contents of litter form being blown or deposited upon any public or private place.
142-4(C) No person shall drive or move a truck within the borough, the wheels or tires of which carry onto or deposit in any street, alley or other public or private place mud, dirt, sticky substances or foreign matter of any kind.
Tree Removal 202-1

No person or corporation shall cut or remove any tree having a circumference of 25.13 inches or greater measured at the widest point of said tree upon any lands within the Borough of Saddle River unless granted prior approval.
202-2 The removal process shall apply to all property owners of the borough who wish to remove five (5) or more trees on parcels of land which are two (2) acres or more in size or three (3) or more trees on parcels of land which are less than two (2) acres and which are in excess of the size referred to above.
False Alarms 67-7 Any person who owns or operates a dial alarm, direct alarm, or local alarm which causes a false alarm shall not be subject to any penalty for the first two (2) occurrences within a calendar year. On the third (3) occurrence within the same calendar year, a written warning will be issued by the police department. On the fourth (4) occurrence within the same calendar year, a summons will be issued and the owner liable for a penalty of fifty dollars ($50).
Garage Sales 121-2 It shall be unlawful for any person to conduct a garage sale in the Borough of Saddle River without first filing with the Borough Clerk in order to obtain a license to do so.
121-4 Any garage sale authorized, shall be conducted between the hours of 9:00am and 6:00pm on weekdays, exclusive of Sunday.
Sunday Closing 134-2 No worldly employment or business conducted for profit, except works of necessity, emergency or charity, shall be performed or practiced by any person within the borough on Sunday. This is to include, but not limited to: Open Houses, Residential or Commercial construction  and Landscaping.
Snow Removal 191-19(A) It shall be unlawful for any person to park, abandon or otherwise impede the plowing, sanding, salting or other snow removal efforts within the borough during a snow emergency. Any vehicle which impedes these efforts shall be towed from the roadway by the police department.
191-19(B) The cost associated with the removal and towing of said vehicle shall be the responsibility of the owner. The owner of any vehicle so removed from the borough roadway during a snow emergency shall also be issued a summons by the police department.
191-19(C) It shall be illegal for any owner of property, employee, agent, contractor or other person at any time, to throw or plow snow or ice on the traveled portion of any roadway within the borough after it has been plowed by the borough's snow removal equipment. The person responsible shall be issued a summons and subject to a fine of one hundred dollars ($100).
Recreational Areas 154-8 Prohibited acts in playground or recreational areas in the borough:

(1) Operation of a vehicle off the established roadway
(2) Throw, scatter or deposit any litter, except in receptacles provided.
(3) Use any loud, violent, obscene or profane language or conduct oneself in a disorderly manner.
(4) Break, throw or place any glass on the lawns, walks, roads, benches, tables or other areas.
(5) Permit a dog to run at large
(6) Ride or lead a horse, except upon roads or trails provided for this purpose.
(7) Permit or cause a vehicle to enter any recreational area between one-half (1/2) hour after sunset and one-half (1/2) hour before sunrise.

(8) Carry, possess or dispense any intoxicating liquors, wines or beers, unless permitted to do so by the Council or its representatives.
